1. Services Provided

NOS ANCETRES DELIVERY provides specialized logistics and courier services for the medicaland industrial sectors in Houston, Texas, and surrounding areas. We utilize a 2023 Ford TransitConnect fleet equipped for compliant transport of clinical specimens, pharmaceuticals, andindustrial components.

2. Client Representations & Warranties

• By booking a delivery, the Client warrants that:
  All shipments are legal, non-hazardous (unless specifically disclosed), and properly packaged.
• All medical specimens are prepared in accordance with OSHA Bloodborne Pathogen standards.
• The Client has the authority to ship the items and provide the necessary PHI (Protected Health Information) under HIPAA guidelines where applicable.

3. Shipping & Delivery Terms

• STAT Services: While we prioritize STAT orders, delivery times are estimates and may be affected by traffic, weather, or Houston-area road closures.
• Refusal of Shipment: We reserve the right to refuse any shipment that is improperly packaged, leaking, or poses a safety risk to our drivers or vehicle.
• Proof of Delivery (POD): Digital signatures or photo confirmation shall constitute conclusive evidence of successful delivery.

4. Fees and Payments

• Pricing: Rates are based on mileage, urgency (STAT vs. Standard), and cargo type.
• Waiting Fees: A grace period of 10 minutes is allowed for pickups. Thereafter, a wait fee of $1.00 per minute will be assessed.
• Payment Terms: Standard terms are Net 15. Late payments are subject to a 5% monthly finance charge.

5. Limitation of Liability

• Maximum Liability: Our liability for any loss, damage, or delay is limited to the lesser of the actual value of the goods or $100.00 per shipment, unless a higher value is declared and an additional “Declared Value” fee is paid in advance.
• Indirect Damages: NOS ANCETRES DELIVERY shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or business interruption) resulting from a delayed or failed delivery.

6. HIPAA & Confidentiality

We maintain strict HIPAA compliance. We will not disclose any patient information encountered
during the course of delivery except as required by law or to fulfill the delivery service.

7. Governing Law

These terms are governed by the laws of the State of Texas. Any disputes arising from our services shall be resolved in the courts of Harris County, Houston, TX.
